The Maternity Benefit Act 1961 is one of the most important legislation to protect the employment of a women during the time of her maternity. This Act was framed to honour the dignity of the woman as a mother. The Act further entities the women employees to the fully pain wages during the absence from work to take care of her child.
This Act has been ammended in 2017 and is applicable to the establishment where 10 or more employees are employed. However, there is an eligibility criteria to avail the benefits of the Act which are as follows:-
The women must have worked in an establishment for a period of atleast 80dayd in the past 12 months to avail the benefits of the Maternity Benefit Act.
The main feature of the Amendment Act of 2017 was that now the maternity time period was extended from 12 weeks to 26 weeks. Creche facilities were made available in the establishment with 50 or more representatives and the ladies were permitted four visits per day to the creche.
